Fault for A Car Accident

Updated: Sep 13, 2019

I've said this before, please do not leave the scene of an accident (unless you are

taken away by ambulance) until you have all the evidence to prove the accident

was caused by another driver. That means calling thew police and making sure they

investigate and do a complete report. That means talking to witnesses and getting their contact info. That means taking photos with your cell of the accident scene to show how the accident happened and the damage to all vehicles involved. That means

not only getting the at fault driver's insurance info but if he or she will talk, ask them nicely to admit the accident was their fault and tell them you want to record it on your cell phone just for your records.

I receive calls sometimes where potential clients don't do all of these things and unfortunately they have no way to prove fault. The injured party (you) has the

burden of proof in litigation so the evidence you get at the accident scene is critical to proving your claim.
